Acceptance

Welcome to TCG Yomitori. These Terms of Service ("Terms") govern your access to and use of our platform and related services ("Service"). By creating an account or making a payment, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use TCG Yomitori. By using the Service, you represent that you meet this requirement.

What you're paying for

A monthly subscription that grants you a fixed number of card identification scans per billing period (500 for Plus, 3,500 for Pro). Unused scans do not roll over. Scans that fail due to a server error on our end are refunded automatically.

Acceptable use

One subscription per individual or business. Don't share your login. Don't use the Service to identify cards that aren't in your possession or that you don't have the right to sell. Don't attempt to reverse-engineer our infrastructure or circumvent the scan cap. Respect our rate limits and fair use guidelines.

Account and security

You are responsible for maintaining the security of your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

Billing and cancellation

Billing. Subscriptions are billed in advance on a recurring monthly basis until canceled.

Cancel anytime. You can cancel effective at the end of your current billing period from your Billing page. Cancellation stops future charges but does not issue a retroactive refund.

Refunds

All fees are non-refundable, except where required by law or if we separately state otherwise in writing. This includes situations where you forget to cancel before renewal or no longer use the Service after purchase.

We will correct billing errors (duplicate charges, wrongful charges) and may issue a refund at our discretion for verified service outages that materially prevented use. You can cancel any time from your Billing page to avoid future renewals.

User content and Service improvement

Ownership. You retain all rights to images and other content you upload ("User Content").

License to us. You grant TCG Yomitori a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and create derivative works from your User Content for the purpose of operating, securing, and improving the Service, including developing and improving our identification accuracy.

Privacy safeguards. Where feasible, we may de-identify or aggregate User Content used for improvement. We do not sell your personal data.

Opt-out. If you prefer that your future uploads not be used to improve the Service, contact us at [email protected]. Opt-out will not require deleting models already trained, but we will exclude your future uploads from improvement work after we process your request.

Your responsibility. You represent that you have the rights and permissions to upload User Content and to grant the above license.

Intellectual property

All platform code, design, and branding are the property of TCG Yomitori or our respective licensors. Except for the limited license you grant to us above for Service operation and improvement, User Content remains yours. You may not copy, reproduce, or redistribute any part of the platform without written permission.

Integrations and third parties

TCG Yomitori integrates with third-party services such as eBay and TCGplayer to enable CSV export and listing workflows. Use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services you connect.

Disclaimers

The Service is provided "as is" without warranties of any kind. While we target high identification accuracy, results can be wrong, particularly on damaged or poorly lit photos. Always review listings before submitting them to a marketplace. Market prices are sourced from third parties and may be stale.

TCG Yomitori is not affiliated with The Pokémon Company, Wizards of the Coast, eBay, TCGplayer, or any other marketplace mentioned.

Limitation of liability

To the fullest extent permitted by law, TCG Yomitori and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our maximum cumulative liability is limited to the amount you paid us in the prior 12 months.

Termination

We may suspend or terminate your access at any time, with or without cause or notice, if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

Changes to terms

We may update these Terms occasionally. We'll notify you of material changes via email or in-app notice. Continued use after the notice period constitutes acceptance.

Mandatory consumer rights

Nothing in these Terms limits any non-waivable consumer rights that apply in your jurisdiction (for example, cooling-off periods, auto-renewal disclosures, or error-charge refunds). Where such rights apply, we will honor them.
